Stuart Tubis is a civil litigator representing clients in a wide range of legal matters, particularly privacy and cybersecurity issues involving the California Invasion of Privacy Act (CIPA), California Consumer Privacy Act (CCPA) and California Consumers Legal Remedies Act (CLRA). Stuart also defends clients against Americans with Disabilities Act (ADA) and Unruh Civil Rights Act claims. He counsels businesses on compliance and represents their interests in civil litigation in both state and federal court as well as Department of Justice investigations. Stuart has a background in technology, which helps in the growing areas of online privacy and website accessibility. His experience extends to all aspects of litigation, including pleadings, discovery, motion practice, negotiations, arbitration, trial advocacy, settlement, and alternative dispute resolution.  

Stuart earned his J.D. from Harvard Law School in 2011 and a B.A. in Psychology with honors from the University of California, Berkeley in 2006. Stuart also completed coursework in computer programming at Massachusetts Institute of Technology (MIT) in 2010-2011.

Representative Matters
  • Defending a nationwide wave of CIPA claims from a serial litigant. Represents more than 150 businesses across the country against California Invasion of Privacy Act claims brought by one serial pro se plaintiff, who alleges that ordinary website search bars and contact forms transmit user-entered data to third-party analytics and advertising platforms without consent. Stuart built the Firm's response program for these claims, including forensic website audits and confidential CIPA compliance reports identifying pre-consent tracking exposure under Penal Code §§ 631 and 638.51. 
  • Defended Zarco Hotels in a lawsuit brough by a serial ADA plaintiff. Serial ADA plaintiff Orlando Garcia sued Zarco Hotels Inc., the owner and operator of the Hollywood Hotel. Garcia alleged that the hotel's reservation website failed to provide enough detail about physical accessibility features (such as door widths and bathroom dimensions). Stuart proved Garcia's claims to be meritless and won attorneys' fees for Zarco Hotels totally $142,584.90, successfully defended at the California Courts of Appeal.
  • Representing Homary International, a large online home goods retailer, in a class action lawsuit alleging violations of California strike-through pricing, CLRA, and False Advertising Law (FAL). 
  • Nationwide putative class action. Defended Extended Stay America against a putative nationwide class action in the Northern District of California alleging ADA, Unruh Act and UCL violations arising from hotel reservation-system accessibility.
